NEWS Ltd chief general counsel Ian Philip told the Federal Court yesterday he had lied to Telstra, "possibly" defrauded it, and destroyed documents he feared could be used against himself or News in a court case. At issue was a handwritten fax Mr Philip sent to Telstra executive Bruce Akhurst on December 9, 2000, urging Telstra to contribute up to $14 million to help beat a C7 bid for the NRL pay TV rights. When Seven's barrister Jonathan Sumption, QC, opened Seven's $1.1 billion damages suit over the demise of C7 three months ago, he described the fax as "a document of critical importance".
